Terms of Service
Last updated November 6, 2026
These terms are an agreement between you and Or Retire LLC, doing business as iPhone in Bio (“iPhone in Bio,” “we,” “us”). They cover iphoneinbio.com, the sites we host for clients, and the client dashboard. By creating an account, paying for a plan, or using an iPhone in Bio site, you agree to these terms. If you don’t agree, please don’t use the service.
Please read section 16. It says disputes are settled by individual arbitration instead of in court, and that you can’t bring or join a class action against us. It also explains how to opt out.
1. What iPhone in Bio is
iPhone in Bio builds and hosts link-in-bio websites that look and work like a phone. Clients get a site, a web address, and a dashboard to edit it. Visitors (“fans”) can browse a site, sign up for updates, and send photos through the fan camera when the client turns those on.
2. Accounts
- You must be at least 18 to buy a plan or hold a client account.
- Give us accurate information and keep it up to date.
- Keep your password private. You’re responsible for what happens under your account. Tell us right away if you think someone else has gotten in.
- One account per client site, unless we agree otherwise.
3. Plans, payments and cancelling
- Self-serve: a one-time $350 setup fee, then $30/month. Done-for-you: a one-time $450 setup fee, then $30/month. Custom work is priced separately in writing.
- Payments are processed by Stripe. We never see or store your full card number.
- The monthly plan renews automatically every month until you cancel. By starting a plan you authorize us to charge your card each month.
- You can cancel anytime from your dashboard (Billing). You keep access until the end of the month you already paid for, and you won’t be charged again. We don’t give partial refunds for unused time.
- The setup fee covers the work of setting up your phone and isn’t refundable once that work has started. If you cancel before we start, contact us and we’ll refund it.
- If a payment fails, we’ll ask you to update your card. If it isn’t fixed, editing is paused and we may take your site offline.
- We may change prices. We’ll tell you at least 30 days before a change affects your plan, and you can cancel before it does.
- Prices don’t include taxes, which may be added where required.
4. Your content
Your photos, videos, music links, text and other material (“your content”) stay yours. You give us permission to store, copy, resize and show your content as needed to run your site and the service. That permission ends when your content is removed, except for copies kept in backups for a limited time.
You promise that:
- You own your content or have permission to use it, including photos of other people, artwork, logos and music.
- Your content and links don’t break the law or anyone else’s rights.
You are solely responsible for your content and your site. We don’t review content before it goes live, and we aren’t responsible for it.
5. Fan sign-ups, emails and texts
If you turn on the Sign Up app, we collect fan details on your behalf and let you download them. You are the sender of any email or text you send to fans, and you are solely responsible for following the laws that apply, including CAN-SPAM, the Telephone Consumer Protection Act (TCPA), carrier rules, and state and international privacy and messaging laws.
By using fan sign-ups, you confirm that you will:
- Only email fans who ticked the email box, and only text fans who ticked the text box and gave their number.
- Only send the kinds of messages described in the consent wording on your Sign Up app, and keep that wording accurate.
- Honor opt-outs (like replies of STOP or unsubscribe requests) promptly, in every tool you send from.
- Keep your own records of consent once you move fans into another tool.
- Not sell or share fans’ details without their consent.
iPhone in Bio does not send marketing emails or text messages for you. You may not use iPhone in Bio, or any tool or connection we provide, to send text messages to fans. Any texting happens through your own separate provider, under your own account and responsibility.
6. Fan camera
Photos fans send stay hidden until you approve them. You’re responsible for what you approve. We may remove any photo that breaks these terms.
7. Things you can’t do
- Post content that’s illegal, hateful, harassing, sexually explicit involving minors, or that promotes violence.
- Impersonate someone or mislead people about who you are.
- Use a site for scams, phishing, malware or spam.
- Try to get into accounts, data or systems that aren’t yours, test our security without our written permission, or interfere with the service.
- Scrape, copy or resell the service, or flood forms with automated submissions.
We may remove content or suspend or close an account that breaks these rules. Where it makes sense, we’ll tell you first and give you a chance to fix it.
8. Copyright complaints (DMCA)
We respect copyrights and respond to notices under the Digital Millennium Copyright Act. If you believe something on an iPhone in Bio site infringes your copyright, send a notice to our designated agent through hello@iphoneinbio.com with:
- Your name, address, phone number and email.
- The copyrighted work you believe was infringed.
- The web address of the material you want removed, so we can find it.
- A statement that you have a good-faith belief the use isn’t authorized by the owner, its agent, or the law.
- A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
- Your physical or electronic signature.
When we get a valid notice, we’ll remove or disable the material and let the client know. If you’re a client and think it was removed by mistake, you can send a counter-notice with your contact details, the removed material and where it was, a statement under penalty of perjury that it was removed by mistake, your consent to the jurisdiction of the federal court for your area, and your signature. We may restore the material 10 to 14 business days after a valid counter-notice unless the complainant tells us they’ve gone to court. We close the accounts of repeat infringers.
9. Our service
The iPhone in Bio design, code and software belong to us. Your plan gives you the right to use them for your site while your plan is active. We may update or change features over time. We work to keep sites online, but we can’t promise the service will never be interrupted. We rely on providers such as Netlify (hosting and accounts) and Stripe (payments).
iPhone is a trademark of Apple Inc. iPhone in Bio is an independent service and is not affiliated with, sponsored or endorsed by Apple.
10. Ending your plan
If you cancel or your plan ends, your editor is paused and we may take your site offline. Ask us within 30 days if you’d like a copy of your content or your fan list. After that we may delete it.
11. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any promise that the service will meet your needs or produce particular results, such as more fans, streams or sales.
12. Limit of liability
To the fullest extent the law allows, Or Retire LLC, its owners, members, employees and contractors won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if told they were possible. Our total liability for all claims about the service is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
13. You cover us (indemnity)
You agree to defend, indemnify and hold harmless Or Retire LLC, its owners, members, employees and contractors from any claims, lawsuits, fines, penalties, losses and costs (including reasonable lawyers’ fees and court or arbitration costs) that come from:
- your content or your site;
- any email, text message or other communication you send, including to fans who signed up on your site;
- your use of fan sign-ups or fan photos;
- your breaking these terms or any law; or
- your violating anyone else’s rights.
We may choose to control the defense of any such claim, and you’ll cooperate with us. You may not settle a claim that affects us without our written consent.
14. Changes to these terms
We may update these terms. If a change is significant, we’ll let clients know and ask you to agree again before you keep editing. Using the service after that means you accept the new terms.
15. Governing law
These terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules. Any claim that isn’t subject to arbitration will be brought only in the state or federal courts located in the State of New York, and you and we agree to their jurisdiction.
16. Arbitration and class-action waiver
Try to resolve it first. If you have a dispute with us, contact us through hello@iphoneinbio.com and describe it. We’ll both try in good faith to resolve it within 60 days before starting arbitration.
Arbitration. Any dispute, claim or controversy between you and Or Retire LLC about these terms or the service will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, instead of in court. The arbitrator can award the same individual relief a court could. Arbitration may be held by video or phone, or in the county where you live. Either of us may instead bring an individual claim in small claims court if it qualifies. Either of us may also go to court to stop infringement or misuse of intellectual property.
No class actions. You and we each may bring claims only on an individual basis, not as a plaintiff or class member in any class, group, collective or representative action. The arbitrator may not combine more than one person’s claims. You and we waive any right to a jury trial.
Opt out. You can opt out of this section within 30 days of first agreeing to these terms by contacting us through hello@iphoneinbio.com with your name, account email and a statement that you opt out of arbitration.
If the class-action waiver is found unenforceable for a claim, that claim will go to court, not arbitration, and the rest of this section still applies.
17. Everything else
These terms are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a part right away, we haven’t given up the right to later. You can’t transfer these terms without our consent; we may transfer them if the business is sold or reorganized.
